These Terms and Conditions ("Terms") govern your use of the Sets Tech Properties website and our residential lettings services. By accessing our website or engaging our services, you agree to be bound by these Terms. Please read them carefully.

Sets Tech Properties Ltd ("we", "us", "our") is a residential lettings platform based in London, United Kingdom. These Terms are governed by the laws of England and Wales.

1. Definitions

• "Website" means the Sets Tech Properties website accessible at this domain
• "Services" means our residential property lettings, tenant matching, and related services
• "Tenant" means any individual who enquires about, applies for, or enters into a tenancy through our platform
• "Landlord" means any property owner who lists a property with us
• "Property" means any residential property listed on our platform
• "Tenancy Agreement" means the legally binding Assured Shorthold Tenancy (AST) or other tenancy contract entered into between the landlord and tenant

2. Use of Our Website

By using our website, you warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into binding agreements
• All information you provide is accurate, current, and complete
• You will use the website only for lawful purposes and in a manner that does not infringe the rights of others

You must not use our website to transmit any unsolicited or unauthorised advertising, to harvest contact details, to upload viruses or malicious code, or to attempt unauthorised access to any part of our systems.

3. Property Listings & Information

All property listings on our platform are provided in good faith. However:

• Property information, including descriptions, photographs, and floor plans, is provided for general guidance only and does not constitute a contractual representation
• Availability of properties is subject to change without notice
• We strongly recommend that prospective tenants conduct their own inspections and due diligence before entering any agreement
• While we take reasonable steps to verify property information, we cannot guarantee its absolute accuracy at all times

4. Tenant Applications & Referencing

To apply for a tenancy through Sets Tech Properties, prospective tenants must:

• Complete an application form and provide truthful information
• Submit to a credit and reference check conducted by an approved referencing agency
• Provide proof of identity and address as required by UK law
• Undergo a Right to Rent check as required under the Immigration Act 2014 and the Immigration (Residential Accommodation) (Prescribed Requirements and Codes of Practice) Order 2014

We reserve the right to decline any application without stating reasons, subject to our obligations under the Equality Act 2010.

5. Tenancy Agreements

All tenancies arranged through Sets Tech Properties are governed by:

• The Housing Act 1988 (as amended by the Housing Act 1996)
• The Tenant Fees Act 2019
• The Deregulation Act 2015
• The Renters (Reform) Act 2024 (as applicable)
• Any other applicable UK legislation in force at the time of the tenancy

5.1 Assured Shorthold Tenancies (AST)

Unless otherwise agreed in writing, tenancies will be structured as Assured Shorthold Tenancies under the Housing Act 1988. The minimum term is typically 12 months unless stated otherwise in the listing.

5.2 Tenancy Deposits

In accordance with the Housing Act 2004 and the Localism Act 2011, any tenancy deposit received will be protected in a government-approved Tenancy Deposit Protection (TDP) scheme within 30 days of receipt. Tenants will be provided with the required Prescribed Information. The maximum deposit is capped at five weeks' rent where annual rent is under £50,000, as set out in the Tenant Fees Act 2019.

5.3 Holding Deposits

A holding deposit of no more than one week's rent may be requested to reserve a property while referencing is completed. This will be applied to the first month's rent or returned, in accordance with the Tenant Fees Act 2019.

6. Tenant Fees

In compliance with the Tenant Fees Act 2019, we do not charge tenants any prohibited fees. Permitted payments include:

• Rent as set out in the tenancy agreement
• Tenancy deposit (capped at five weeks' rent)
• Holding deposit (capped at one week's rent)
• Charges for lost keys or security fobs
• Late payment interest (not exceeding 3% above the Bank of England base rate)
• Variation of contract fee (capped at £50 including VAT)
• Early termination fee (not exceeding the landlord's financial loss)

7. Maintenance & Repairs

Landlords are responsible for maintaining the property in a good state of repair in accordance with the Landlord and Tenant Act 1985, the Homes (Fitness for Human Habitation) Act 2018, and the Decent Homes Standard.

Tenants must report maintenance issues promptly. Sets Tech Properties will coordinate with landlords and approved contractors to address repairs in a timely manner. Emergency maintenance will be responded to within 24 hours; non-urgent repairs within a reasonable timeframe.

8. Equality & Non-Discrimination

Sets Tech Properties is committed to equal opportunity in housing. We operate in full compliance with the Equality Act 2010 and will not discriminate against any applicant or tenant on the basis of age, disability, gender reassignment, marriage and civil partnership, pregnancy and maternity, race, religion or belief, sex, or sexual orientation.

9. Intellectual Property

All content on our website, including text, images, graphics, logos, and software, is the intellectual property of Sets Tech Properties Ltd or our licensors and is protected by UK and international copyright law. You may not reproduce, distribute, or create derivative works without our prior written consent.

10. Limitation of Liability

To the fullest extent permitted by law:

• We exclude all implied warranties and conditions in connection with our website and services
• We shall not be liable for any indirect, incidental, special, or consequential loss arising from your use of our website or services
• Our total liability to you in connection with any matter shall not exceed the fees paid by you to us in the preceding 12 months

Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under English law.

11. Complaints Procedure

We are committed to handling all complaints fairly and promptly. If you wish to make a complaint:

2. We will acknowledge your complaint within 3 working days
3. We aim to resolve all complaints within 15 working days
4. If you remain dissatisfied, you may refer your complaint to an independent redress scheme

Sets Tech Properties is a member of a government-approved redress scheme as required by the Estate Agents Act 1979 and the Redress Schemes for Lettings Agency Work and Property Management Work (Requirement to Belong to a Scheme etc) (England) Order 2014.

12. Anti-Money Laundering

Sets Tech Properties complies with the Money Laundering, Terrorist Financing and Transfer of Funds (Information on the Payer) Regulations 2017. We are required to conduct Customer Due Diligence (CDD) checks on landlords and, where applicable, tenants, and to report any suspicious activity to the National Crime Agency (NCA).

13. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Changes to These Terms

We reserve the right to update these Terms at any time. The "last updated" date at the top of this page will reflect any changes. Continued use of our website or services following any update constitutes acceptance of the revised Terms.
